Terms & Conditions – Max Johnston Swimming Online Portal

By purchasing a subscription to The Ultimate Baby & Toddler Swimming Portal (“the Portal”), you (“the Customer”) agree to the following terms and conditions. Please read these carefully before completing your purchase.
1. Access & Membership
1.1 Your subscription grants you personal, non-transferable access to the Portal content for the duration of your active membership.
1.2 You must not share your login details with others. Doing so may result in immediate cancellation of your membership without refund.
1.3 We reserve the right to update, modify, or remove content from the Portal at any time to improve the service.
2. Payments & Renewals
2.1 All prices are listed in GBP (£) and include VAT where applicable.
2.2 Subscription payments are taken on a recurring monthly basis unless otherwise stated at checkout.
2.3 If payment fails, access to the Portal will be paused until the payment is successfully processed.
2.4 We reserve the right to change subscription pricing. You will be notified at least 30 days before any change takes effect.
3. Refunds & Cancellations
3.1 Due to the digital nature of the Portal, refunds are not available once access has been granted, except where required by UK consumer law.
3.2 You can cancel your subscription at any time via your account settings. Your access will continue until the end of your current billing cycle.
3.3 No partial refunds will be given for unused membership periods.
4. Health & Safety Disclaimer
4.1 All swimming activities involve inherent risks. You acknowledge that you are responsible for your own safety and the safety of the child in your care when following our guidance.
4.2 The information provided in the Portal is for educational purposes only and is not a substitute for professional in-person swimming lessons.
4.3 You must ensure that swimming activities take place in a safe environment, under constant adult supervision, and in compliance with any applicable safety regulations.
4.4 Max Johnston Swimming will not be liable for any injury, loss, or damage arising from use of the Portal content.
5. Intellectual Property
5.1 All videos, written materials, images, and other content in the Portal are the property of Max Johnston Swimming and are protected by copyright laws.
5.2 You may not copy, share, reproduce, or distribute any content without our prior written consent.
6. Technical Requirements
6.1 It is your responsibility to ensure you have the necessary internet connection, device, and software to access the Portal.
6.2 We are not responsible for any technical issues on your side that prevent you from using the service.
7. Limitation of Liability
7.1 To the fullest extent permitted by law, Max Johnston Swimming excludes all liability for any indirect, incidental, or consequential damages arising from your use of the Portal.
7.2 Our total liability to you for any claim will not exceed the total amount you have paid for your membership in the previous 12 months.
8. Privacy & Data Protection
8.1 Your personal data will be collected and processed in accordance with our Privacy Policy, available on our website.
8.2 We will never share your personal details with third parties for marketing purposes without your consent.
9. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
